Terms of service
1. General provisions
These purchase and sale rules (hereinafter referred to as the Rules) determine the mutual rights, duties and responsibilities of the person purchasing goods in this electronic store (hereinafter referred to as the Buyer) and Darius Lažinskas (hereinafter referred to as the Seller), when the Buyer purchases goods in the electronic store. By purchasing goods in the online store, the Buyer agrees to the application of these Rules.
2. The moment of conclusion of the purchase and sale contract
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer creates a basket of goods in the electronic store, specifies the delivery address, selects the payment method and presses the "Confirm ✔️" button, and is valid until the full fulfillment of the obligations under this agreement. In cases where the Buyer does not agree with all or a certain part of the Rules, he must not place the order.
2.2. Each contract concluded between the Buyer and the Seller is stored in the database of the electronic store.
3. Buyer's rights
3.1. The buyer has the right to buy goods in the electronic store in accordance with these Rules and the legal acts of the Republic of Lithuania.
3.2. The buyer (user) has the right to cancel the contract for the purchase and sale of goods concluded in the electronic store with the Seller by notifying the Seller in writing within 7 working days from the day of delivery of the goods. The buyer has the right to withdraw from the contract for the purchase and sale of goods with the seller only if the goods are of high quality, have not been damaged and have not substantially changed their appearance.
3.3. The buyer has other rights provided for in the Rules and legal acts of the Republic of Lithuania.
4. Responsibilities of the buyer
4.1. The buyer must pay the price of the goods and their delivery, as well as other payments (if specified when concluding the contract) and accept the ordered goods. The Buyer pays for the goods by paying through Paysera, bank transfer or the PayPal system.
4.2. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.
4.3. The buyer must comply with other Terms and Conditions and the requirements established by the legal acts of the Republic of Lithuania.
5. Seller's Rights
5.1. If the Buyer tries to harm the work or stable operation of the electronic store or violates his obligations, the Seller may limit, suspend (terminate) his access to the electronic store without prior warning and is not responsible for any related losses of the Buyer.
5.2. The Seller has the right to temporarily or indefinitely terminate the operation of the electronic store without separate notice and is not responsible for any related losses of the Buyer.
5.3. The seller has the right to unilaterally change these Rules by publishing the changed Rules on the website of the electronic store. Changes take effect from the moment of publication for all transactions concluded after publication.
5.4. The seller has other rights provided for in the Rules and legal acts of the Republic of Lithuania.
6. Responsibilities of the seller
6.1. The Seller undertakes to make efforts to enable the Buyer to properly use the services provided by the electronic store. The seller does not make any guarantees that the online store will operate without interruption or that data transmission will be error-free. The Seller is not responsible for any losses of the Buyer related to malfunctions of the electronic store and/or data transmission errors.
6.2. The Seller, in the event of important circumstances, being unable to provide the ordered product to the Buyer, undertakes to offer an analogous product, and if the Buyer refuses to accept the analogue of the product, to return the money paid by the Buyer within 5 working days. In this case, the Seller is released from responsibility for non-delivery of the goods.
6.3. The seller undertakes to comply with other requirements set forth in these rules.
7. Delivery of goods
7.1. The goods are delivered by the transport company at the expense of the Buyer. In individual cases specified by the Seller, the goods are delivered at the Seller's expense.
7.2. The exact delivery price depends on the price and weight of the ordered goods, so the final delivery price will be determined only after the order is placed.
7.3. Delivery of goods is ordered separately before payment for goods and selected services. The Buyer pays for the delivery service. In individual cases specified by the Seller, the delivery service is paid for by the Seller.
7.4. Usually, the goods are delivered to the address specified by the Buyer within 2-5 working days from the receipt of payment for the goods and transportation of the goods, if the goods are in the Seller's warehouses. The Seller does not guarantee that the goods will be delivered within the period specified in the previous sentence in all cases, especially if the ordered goods are not in the Seller's warehouses. The delivery of goods is carried out throughout the territory of the Republic of Lithuania, including the Curonian Spit (additional charge applies).
7.5. The exact date of delivery of the goods is indicated in the e-mail notification provided by the Seller to the Buyer. to the postal address specified by the Buyer in the registration form. Accordingly, the Buyer, having entered into a purchase and sale agreement, undertakes to check the aforementioned e-mail every day. mailbox, until a notification about the delivery of the goods is received.
7.6. During the delivery of the shipment, the Buyer or, depending on the case, the Buyer's representative must together with the representative of the transport company check the condition of the package, the quantity, quality and assortment of the goods.
7.6.1. If a violation of the package of the shipment is detected, but if there is no discrepancy in the quantity, quality, or assortment of the goods, the Buyer or, depending on the case, the representative of the Buyer must mark the violation of the package of the shipment in the data logger provided by the representative of the transport company or in the paper delivery confirmation.
7.6.2. If the quantity and/or quality and/or assortment of the goods is found to be inconsistency(s), the Buyer or, depending on the case, the Buyer's representative must not accept the shipment. In this case, the representative of the transport company, together with the Buyer or, depending on the case, the Buyer's representative, fills out a special shipment inspection report, in which he notes the violations found.
7.6.3. After the buyer or, depending on the case, the buyer's representative accepts the shipment and signs the data logger provided by the representative of the transport company or the paper delivery confirmation and notes about the violation of the package of the package, it is considered that the goods were delivered in the damaged package of the package, but the quantity, quality, and assortment of the goods correspond to the sales contract. the terms of the contract, the additional services specified in the data logger or the paper delivery confirmation have been properly performed.
7.6.4. After the buyer or, depending on the case, the buyer's representative accepts the shipment and signs the data logger provided by the representative of the transport company or the paper delivery confirmation without comments, it is considered that the goods were delivered in the undamaged package of the shipment, the quantity, quality, and assortment of the goods comply with the terms of the sales contract, additional services , specified in the data logger or on the paper delivery confirmation, have been properly completed.
7.7. Upon delivery of the goods to the address specified by the buyer, the goods are considered to have been delivered to the Buyer, regardless of whether the goods are actually accepted by the Buyer or any other person who accepted the goods at the specified address. If the goods are not delivered on the planned day of delivery, the Buyer shall inform the Seller immediately, but no later than the next day after the planned day of delivery of the goods. Otherwise, the Buyer loses the right to submit claims to the Seller related to non-delivery or late delivery of goods.
7.8. If the goods will not be accepted by the Buyer, the Buyer must specify the data of the person who will accept the goods when filling in the delivery information of the order.
8. Return of goods
8.1. If the Buyer (user) refuses the contract of purchase and sale of the goods, as stipulated in clause 3.2 of the Rules, the goods are returned to the Seller and the money paid by the Buyer for the goods is returned within 10 working days from the receipt of the written notification from the Buyer about the refusal of the purchase and sale contract.
8.1.1. The goods are returned in the original product and shipment packaging. When returning, it is necessary to attach the original invoice that the Buyer received with the shipment, if all the goods delivered according to the relevant invoice are returned, or a copy of the invoice, if a part of the goods delivered according to the relevant invoice is returned, a completed and signed notice of withdrawal from the purchase and sale contract.
8.1.2. The Buyer is responsible for the proper assembly and packaging of the returned goods. If the product is not complete and/or properly packed, the Seller does not accept the returned product.
8.1.3. Goods cannot be returned if they have been used and/or have been damaged and/or have lost their marketable appearance.
9. Liability
9.1. The buyer is responsible for the correctness of the data provided in the registration form. The buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided in the registration form.
9.2. The parties are responsible for the violation of the purchase and sale contract concluded using the electronic store in accordance with the procedure established by the legal acts of the Republic of Lithuania.
9.3. In the case of unreasonably refusing to accept the goods or their part during the delivery of the goods, the Buyer shall pay the Seller a fine of 10% of the price of the refused goods.
9.4. Taking into account Article 8 of the Electronic Signature Law of the Republic of Lithuania. on the 3rd provisions, the Buyer agrees with the Seller that the confirmation of the Buyer's actions in the electronic store with the login data (identification code) of the electronic store has Article 8 of the Electronic Signature Law. 1 d. established legal power of an electronic signature (ie has the same legal power as a signature in written documents and is admissible as a means of proof in court). The buyer must keep his login data to the online store and not disclose them, ensure that the data is known only to him and only he uses the data, not to transfer or otherwise enable other persons to get acquainted with or use the data. If there is a suspicion that the login data could have been obtained by another person, immediately notify the Seller about it, as well as immediately inform the Seller about the violation or disclosure of the login data to the electronic store. All actions performed using the Buyer's identification code are considered to be performed by the Buyer, and the Buyer assumes full responsibility for the consequences of such actions.
9.5. The Seller is not responsible for the information provided on the websites of other companies, even if the Buyer accesses these websites through the links in the Seller's electronic store.
9.6. The seller is not responsible for the fact that the color, shape or other parameters of the goods displayed in the online store do not correspond to the real size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
9.7. In the event of damage, the guilty party compensates the other party for the direct losses incurred due to its fault.
10. Processing of personal data
10.1. By pressing the "Confirm ✔️" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree to provide the Seller with his personal data specified in these rules and the registration form, and does not object to the personal data provided by the Buyer and/or his representatives being processed by the Seller for the purpose of online shopping.
10.2. By clicking the "Confirm ✔️" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree that the personal data of the Buyer and/or his representatives provided by the Buyer and/or his representatives will be provided to third parties selected by the Seller in order to they would process them for the purpose of online shopping as discussed in the next point.
10.3. By pressing the "Confirm ✔️" button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree to present one of the personal identification documents to the Seller and (or) the third person who delivered the goods on the Seller's instructions when picking up the goods at the place of pick-up: a passport , personal identity card, driver's license of a new model, in order to properly identify the Buyer and/or his representatives for the purpose of online shopping. The Buyer also confirms that he and his representatives (the Buyer has the consent of his representatives) agree that during the collection of the goods, at the place of collection of the goods, the Seller and/or the third person who delivered the goods on the Seller's instructions will sign the personal identification provided by the Buyer and/or his representative document data and would process this data (including but not limited to the transfer of data to the Seller) for the purpose of online trading.
10.4. By pressing the "Confirm ✔️" button, the Buyer confirms that he (if the Buyer is a natural person) and his representatives are informed of their right to access their personal data processed by the Seller and how they are processed, to demand correction, destruction of their personal data or to suspend their personal data processing actions, when the data is processed in violation of the provisions of the law, to object to the processing of their personal data for any of the purposes.
10.5. By pressing the "Confirm ✔️" button, the Buyer confirms that he and his representatives know that they have the right to refuse to provide their personal data, but understand that personal data are necessary and necessary in order to unambiguously identify the Buyer and/or his representatives for the purposes of online shopping and without providing a personal data and/or do not consent to their processing for the purpose of online trading, will not be able to conclude and/or execute the contract.
11. Sending information
11.1. The Seller sends all notifications to the e-mail address provided in the Buyer's registration form.
11.2. The Buyer sends all messages and questions to the address specified in the "Contacts" section of the Seller's e-store.
12. Final Provisions
12.1. The Buyer and the Seller agree that all information that is provided on the Seller's online store website (including, but not limited to, these Rules, information about the Seller, the offered goods and services and their characteristics, the Buyer's right to refuse the purchase and sale contract implementation procedure, the Seller's product maintenance services and guarantees (if they are provided)) are considered to be provided to the Buyer in writing.
12.2. These Rules do not limit the Buyer's (user's) rights established in the legal acts of the Republic of Lithuania.
12.3. All disputes arising out of or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved by negotiation. If it is not possible to reach an agreement, disagreements are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
13. Payment methods
Payment can be made using electronic banking services of Swedbank, Seb, Luminor, Citadele and Šiaulių bankas. Settlements are possible in euro currency. Payments are processed using the paysera payment platform.
